Terms of Service (ToS)
for the use of yapuso

Welcome to yapuso! These Terms of Service (ToS) govern the use of our app, which allows you to record trips, create notes and journal entries, and manage photo albums. By registering and using our app, you agree to these ToS.

1. Scope and Subject Matter of the Contract

1.1 These ToS apply to all users of the app, regardless of their location.

2. Registration and User Account

4. User Obligations and Code of Conduct

4.1 You may only use the app for legal and personal purposes.
4.2 It is prohibited to upload content that violates applicable law, in particular:

• Copyrighted content without appropriate authorization.
• Content that is offensive, discriminatory, or obscene.

4.3 You agree not to use automated systems (e.g., bots) to use the app.

6. Costs and Payment Terms

6.1 The basic use of the app is free. A paid subscription may be required for advanced features or storage space.
6.2 Prices and payment terms for paid features are displayed within the app.

7. Liability and Warranty

7.1 The provider is not liable for damages caused by improper use of the app or data loss.
7.2 To the extent permitted by law, the provider's liability is limited to intent and gross negligence.

8. Termination and Deletion of the Account

8.1 You can delete your account at any time. All stored data will be irrevocably removed unless legal retention periods prevent this.
8.2 The provider reserves the right to suspend or terminate your account if you violate these ToS.

9. Rights to Content

9.1 You retain full copyright to the content you create or upload in the app.
9.2 By uploading content, you grant the provider a non-exclusive, worldwide license to use this content to provide the app services.

10. Geographic Availability and Uptime

10.1 The app is generally available worldwide, but certain features or services may be restricted or unavailable in certain regions, depending on local laws, technical conditions, or the terms of our third-party providers.
10.2 The provider strives to ensure high availability of the app but cannot guarantee uninterrupted accessibility or error-free operation. Short-term outages, maintenance work, or technical problems may restrict use.
10.3 The provider reserves the right to deactivate the app or parts thereof in certain regions or restrict access if necessary.

11. Applicable Law and Jurisdiction

11.1 For users in the European Union, the law of the country in which the user has their habitual residence applies.
11.2 For users in Switzerland, the place of jurisdiction is Bern.
11.3 Any disputes are to be resolved before the competent courts of the respective jurisdiction.

12. Changes to the ToS

12.1 The provider reserves the right to change these ToS. Changes will be communicated to users at least 30 days before they take effect via email or within the app.
12.2 By continuing to use the app after the changes take effect, you agree to the new ToS.
